A lawyer for the Canadian bus company that is facing a lawsuit for a fatal crash in Oregon has claimed that black ice and not driver fatigue is to blame for the crash.

Nine people were killed and 38 injured on the day before New Year’s Eve. The company has been banned from operating in the United States due to an alleged pattern of not following federal safety regulations.

The lawyer claims that there were other accidents in the area on the same day near Pendleton, Ore. He says the driver had enough sleep the previous night and was not impaired.
