Deadline for Filing a Claim

A lawsuit must be filed before the applicable deadline (known as the "statute of limitations") passes if you suffer a personal injury, or your claim will be forever barred. It is therefore vitally important that you immediately consult with an attorney if you have suffered a personal injury and you believe someone else is responsible for causing that injury.

The specific time limitation will depend on the type of injury and the circumstances. In general, a personal injury lawsuit must be filed within three years of the date the injury occurred. But under some circumstances, action must be taken in less time. For example, if you believe a governmental entity is responsible for causing your injury, you must file a claim within two years of the injury. There are other time limitations if you need to sue a doctor for medical malpractice.
