The estate of a man who was killed last year when a car crashed into him at the end of a high speed chase has filed a wrongful death lawsuit against the City of Federal Way, the Department of Corrections, and the woman who they were chasing, according to news sources.
The 8-time felon who ran into the victim’s car had several violations prior to the incident which the case believes she should have been arrested for earlier. The lawsuit also says that officers should have avoided chasing the felon down the Highway when they saw how recklessly she was driving.
The woman police were chasing, who was allegedly driving under the influence, pleaded guilty to vehicular assault, attempting to elude a police vehicle, and second-degree murder. She is now serving a prison sentence of 24 years.
Simmons’ estate is seeking unspecified damages for medical bills, loss of employment, and emotional damage.
